APC insists on Deputy Senate President Ekweremadu's removal


LagosgistAPC says Deputy Senate president Ike Ekweremadu who is a member of PDP must be removed from office. Senator Ekweremadu who was also the deputy senate president in the last administration, was elected deputy senate president during the controversial senate leadership election on June 9th which produced Senator Bukola Saraki as Senate President. A member of the ruling party who spoke on condition of anonymity with Punch, said Ekweremadu serving as deputy senate president will adversely affect President Buhari's administration. He also added that President Buhari has refused to see Senator Saraki and Hon Dogara since their emergence as Senate President and Speaker. "As deputy senate leader, Ekweremadu is automatically the Chairman, Senate Committee on Constitution Amendment. This is a sensitive position that, statutorily, should not be held by the minority. Ekweremadu and his PDP co-travellers will hamper the policies of the Buhari government. By the virtue of Senate rules, a member of the minority is not supposed to be the deputy senate leader; so, he is occupying the post illegally. Local Content Law Implementation: A Call for Retaining Oil Swap and Subsidy Removal


LagosgistBoth legal and oil experts have advised that the Nigerian independent oil operators should be considered first in the award of Oil and Gas contracts. Nigerian service companies should also be considered for contracts and services in line with the local content law just as they called for subsidy removal. Lagosgist A legal expert Bar. Ayo Samuel noted that the “Local content Law specifies that Nigerian independent operators be given “first consideration” in the award of Oil and Gas focused contracts and Nigerian service companies be given “exclusive consideration” for contracts and services. This is the dilemma that the government is facing. Experts say that an agreeable compromise will be a scenario where Nigerian Companies are allowed to participate, along International Oil Majors”. President Muhammadu Buhari’s cash strapped government may have to do away with fuel subsidies in order to channel scarce resources to capital project development in Nigeria. This is in line with the views of Industry experts and Global Investment banks who agreed that a solid structured and transparent swap arrangement will ensure product availability even as NNPC refineries are operating below their plate capacity. “Subsidies are expensive, accounting for an average of 2.5 percent of the gross domestic product from 2006-2012, according to the IMF. The government set aside N914 billion ($4.6 billion) for it in 2014. Nigeria’s national oil company the NNPC currently receives about 450,000 barrels per day for its refineries to process for domestic crude consumption. However Nigeria is almost wholly reliant on imports for the 40 million litres per day of gasoline it consumes, as most of the NNPCs four refineries produce at less than 20-60 percent of their name plate capacity. The NNPC has often had to engage in crude for oil (swap) and offshore processing contracts and direct importation of products to bridge about 50 percent of the supply gap. The Managing Director and Head – Africa Macro Global Research at Standard Chartered, Razia Khan said: “Having contracts directly with the oil majors for refined product would be a big win, said Razia Khan, adding, “Ultimately, the healthiest development would be to sell the refined product to end-users at cost-reflective prices. “Any savings from a fuel subsidy could increase the amount that Nigeria spends on social safety nets – so that the poorest, most vulnerable Nigerians benefit directly,” Khan said. This view was corroborated by members of the Independent Petroleum Marketers Association of Nigeria (IPMAN); they stated in recent news report that the Oil Swaps is a better option for Government to end scarcity and keep off subsidy payment. The association further made a case to government for IPMAN members to partake in the Crude Oil Swap Arrangement. While many Nigerians may believe that the Crude Swap/ OPAs was a recent arrangement under the immediate past administration, our source within the NNPC stated that Crude Swap/ Offshore Processing Arrangements have been a Federal Government initiative since 1977 in partnership with International Oil companies (IOCs). The anonymous source reiterated that “Nigerians must know that the supposed interim policy of the NNPC to bridge the gap between petroleum products demand and supply was initiated over three decades ago between 1977 and 1986 when Nigeria needed heavy crude from Venezuela to feed the Kaduna refinery. We as a nation swapped Venezuela heavy crude for Nigeria’s light crude”. He further stated that: “the scope of crude swap was later broadened specifically because our refineries began to produce below their stipulated name plate capacity. In addition, NNPC/PPMC from late 1990s-2010, imported Petroleum Products on an Open Account backed by a PPMC Payment undertaking stating that payment will be made 45 days after imported vessels arrive, this payment timeline was never met with payment delays running to 400 days late in backlogs. Our research findings indicated that NNPC has an outstanding debt to Importers and Bankers of close to USD 2 Billion currently standing at 7 Years late payment. Consequently, for any NNPC/PPMC import project to receive a nod, the financing bank will need to see and verify a “Solid Bankable Security or Guarantee” in order to finance such project. NNPC/PPMC usually rely on refineries un-utilised Crude oil barrels to fund these open account Payment Batches. However, the foregoing challenge posed a problem to 50% of fuel supply into Nigeria around 2009 and 2010. In order to close the supply gap and avert scarcity crisis, NNPC/PPMC advertised in 2009 inviting for proposals for Offshore Processing Arrangement and other proposals to guarantee fuel supply to Nigeria. Thus crude Swap/ OPAs concept widened to include crude for refined products, which had been in practice with Oil Majors more than two decades; at the time, British Petroleum and SIR refinery of Ivory Coast were engaged to swap crude for refined products under very shadowy terms. Yet no one complained, this begs the question: why the outrage when Nigerian companies were engaged to deliver same service to the NNPC/PPMC?Perhaps it is easier to become outraged when the government of Nigeria, partners with indigenous oil and gas companies towards promoting local content laws than be dismayed by the many years of International Oil Companies (IOCs) under cutting Nigerians in disguise of service to a people. Nonetheless, the industry is witnessing increased participation of Nigerian oil and gas companies and expressed concerns on the direction the new administration may take while being optimistic that our government will deepen the gains in the oil and gas sector as a result of promoting local content development. According to verifiable data, Nigerian companies now control over 35% of upstream business activities in Nigeria. This significant bump from less than 10% in 2010 is as a result of passing the local content act into law; driven by the Nigerian Content Development and Monitoring Board (NCDMB). Sadly, these local companies are faced with herculean task of dealing with various challenges associated with doing business in Nigeria. This has been recently demonstrated when perceived ANTI-LOCAL CONTENT AGENTS conspiring with International News and Reporting Policy analyst, unleashed a media onslaught against indigenous companies participating in the Crude for Products Exchange Agreement, that is aimed to provide petroleum products to the everyday Nigerian. It is very curious to see all of these negative reports and also the exclusion of the names of Foreign and International Companies that have for many years taking part in these SWAP and Offshore Processing Contracts absent from all of these negative reportage. These Foreign companies create wealth and employment for their Countries, why can’t Nigeria do the same with its own people and companies? Our findings indicates that the Crude Swap/OPAs arrangement entails the allocation of crude oil by NNPC for processing in a refinery, depending on the crude type and yield pattern resultant refined petroleum products mainly Gasoline and Kerosene are delivered by the contract operators into the country. The by-products not required are paid in cash to NNPC. A refining fee is paid for this refining. The Contract Operator places a “Bank Stand by Letter of Credit” before it is allowed to lift the crude, as a form of security. The SWAP is a very straight forward arrangement, which simply means you load the Crude Oil and you deliver refined petroleum products on a value to value based contract. Approximately, for a standard Nigerian cargo of 950,000+/- 5% Barrels (950kb) of Crude Oil loaded, the resultant volume for refined products (PMS and DPK which formed the subject matter of this Agreement) is 3 cargoes of 30,000mts +/- 10%. The SWAP Agreement stipulates that a revolving Standby Letter of Credit (SBLC) is established in favour of PPMC, before the Supplier’s vessel is cleared to load any volume of the crude oil nominated and programmed for this purpose. This in effect guarantees that there is no exposure to PPMC for the Crude Oil lifted at any point in time during the Agreement, as this SBLC can be encashed, in the event of default. Curiously, verifiable facts indicated that the terms on which the Federal government engaged local players where far more strenuous than the terms of engagement with the International Companies that partnered with the Federal Government. This in itself was a paradox… It is on record tha when foreigners were handling crude swap and delivering Petroleum Products on Open Account for Nigeria, our government was buying refined products at PLATTS plus $136-180/metric from these multinationals. Government was equally required to pay interest to the multinationals on delayed receivables. Government incurred the cost of logistics and handling. Unlike the arrangement where we have local players participating, only the principle of exchanging crude for refined product remained the same. Local companies sell at PLATTS plus $82/metric Ton. Government does not pay interest on delayed receivables. Yet, the local players remained steadfast towards supporting the Federal Government of Nigeria on making sure that finished products are available and accessible by Nigerians without hassle. Unfortunately, instead of applauding the doggedness of local entrepreneurs, some unscrupulous elements in Nigeria are making frantic efforts to hound and frustrate growth driven by local companies in the sector. This is our quagmire as a people. Accordingly, the implementation of the Local Content Law is one that must be encouraged. Certainly without doubt, the above well documented procedure ensures compliance and discredits the unguided and unfounded opinion of those calling a dog a bad name in order to kill it.

Well, she has pleaded guilty to their murders saying but says she feels no remorse for killing them. She said: “I don’t feel no remorse for the death of them demons.” Mitchelle Blair 36, of Detroit, Michigan, without remorse admitted abusing her 13-year-old daughter Stoni Blair and nine-year-old son Stephen Berry, before their deaths. The bodies of the children were discovered in a deep freezer at her apartment on May 24 when bailiffs arrived to evict her. The mother has two surviving children aged eight and 17-years-old. LagosgistAs she appeared in court, Blair said she killed her children after claiming they repeatedly “gang-raped” her youngest child. Blair however, did not report the alleged sexual abuse and never witnessed it first hand. “She raped my son,” Blair said about Stoni. “I intentionally killed her.” “It wasn’t an accident?” Judge Dana Hathaway asked. “No, not at all and if I had the chance to do it again, I would,” Blair said. “I don’t feel no remorse for the death of them demons.”Blair said she concealed the bodies so she could take care of her surviving children “as long as possible".nStephen died in August 2012, his sister May 2013. The mother admitted strangling Stoni and Stephen before suffocating them by putting bags over their heads until they lost consciousness. The autopsies revealed both children were malnourished, although Blair admitted only to starving Stoni, whom she fed one bowl of porridge a day. FG-Okonjo-Iweala spent $2.1bn without approval


LagosgistThe National Economic Council, chaired by Vice-President Yemi Osinbajo, on Monday accused former Minister of Finance and Coordinating Minister of the Economy, Dr. Ngozi Okonjo-Iweala, of spending $2.1bn from the Excess Crude Account without authorisation. “We looked at the numbers for the Excess Crude Account. The last time the former Minister of Finance and Coordinating Minister of the Economy, Mrs Ngozi Okonjo-Iweala, reported to the council, and it is in the minutes, she reported by November 2014 that we had $4.1 bn. Edo State Governor Adams Oshiomhole told State House correspondents after the NEC’s 58th meeting in Abuja. “Today, the Accountant-General Office reported we have $2.0bn. Which means the honourable minister spent $2.1bn without authority of the NEC and that money was not distributed to states, it was not paid to the three tiers of government,”According to the economic council, the ‘unauthorised’ spending is among the several anomalies discovered in the management of the nation’s economy between 2012 and May 2015. Within the period, the Nigerian National Petroleum Corporation was said to have earned a total of N8.1 tn but remitted only N4.3tn. Due to this reason, the Federal Government has constituted Oshiomhole, Kaduna State Governor, Nasir el-Rufai; Akwa Ibom State Governor, Udom Emmanuel; and Gombe State Governor, Ibrahim Dankwambo, into a panel to probe the NNPC and the ECA between 2012 and May, 2015. Oshiomhole, el-Rufai, Emmanuel and the Zamfara State Governor, Abdulazeez Yari, jointly briefed journalists at the end of the meeting. Yari told journalists, through the Director of Funds, Office of the Accountant-General of the Federation, Mr. M.K. Dikwa, that council members received the report of the ECA and unremitted funds by the NNPC. He said: “On that line, a four-man committee consisting of the governors of Edo, Gombe, Kaduna and Akwa Ibom states was constituted to go through the books of the NNPC and Excess Crude as well as the Federation Account. ”The four-man committee will check the books of the NNPC, most especially the issue of excess crude and what is not remitted into the Federation Account. “The Federal Government, in conjunction with the Central Bank of Nigeria, will look inwards to see how to support and how much they will give to states, especially on the issue of outstanding salaries owed by the states and even the Federal Government.” Explaining what happened at the NEC meeting, Oshiomhole said the NNPC and the Office of the Accountant-General of the Federation were compelled for the first time to provide information on the total sales of Nigeria’s crude from 2012 to May 2015. The Edo governor said, “We are talking about transparency; we are talking about change. And what we saw from those numbers, which I believe that Nigerians are entitled to know, is that whereas the NNPC claimed to have earned N8.1tn, what NNPC paid into the Federation Account from 2012 to May 2015 was N4.3tn. “What it means is that the NNPC withheld and spent N3.8 tn. “The major revelation here is that the entire federation, that is the Federal Government, the states and all the 774 local governments, the amount the NNPC paid into the Federation Account for distribution to these three tiers of government came to N4.3 tn and the NNPC alone took and spent N3.8tn. “This means that the cost of running the NNPC is much more than the cost of running the Federal Government. That tells you how much is missing, what is mismanaged and what is stolen. There are huge figures.” “If the Federal Government cannot spend without appropriation, why should any agency spend without appropriation. “This is what the Constitution provided for and this is what President Muhammadu Buhari has promised to do; henceforth all money must go to the Federation Account. “If you were doing that, you would not have a situation where the NNPC alone will spend N3.8trn and remit to the federal, states and local governments N4.3trn, which means NNPC is taking about 47 per cent and that explains all the leakages you are talking about.” El-Rufai said the account was set up in order to be accountable such that every state and local government would know what they had in the account though they could not spend it. He said, “The Excess Crude Account is 52 per cent owned by the Federal Government and 48 per cent owned by the states and the local governments. “So the decision of the NEC is to set up this committee of four to look at the operations of the Excess Crude Account and make recommendations to council on its future. “The other thing the committee will do is to look at the operations of the Federation Account, particularly the shortfall and again come back to council with very clear recommendations as to what to do. “We have not been given a time frame but as you can imagine state governments are under pressure, many of our state governments are unable to pay salaries on time without recourse to borrowing, so this is very important to us. “This is an all-governors’ committee; we wear the shoes and we know where they pinch. So we are going to do this as quickly as possible. “The next meeting of the council is on July 23; we hope to complete our work and be in a position to report to council on that day. So within the next one month, we will be done by God’s grace.”

One of the girls is the ex-girlfriend of the boy she's dating. Her charred body was found in the bush in Klipgat, North West, on Thursday June 25th. Boitumelo's boyfriend's ex-girlfriend and three of her friends have been arrested for the crime and are facing murder charges and kidnapping. Boitumelo , 18, a Grade 12 pupil at Elepsa Secondary School, became romantically involved with Tokelo Makalepho, 24, from her village, six months ago. Boitumelo's sister, Nono Dlamini, 26, alleged Makalepho's former girlfriend was jealous and could not stand that Makalepho was dating Boitumelo. "She constantly intimidated my sister and threatened her," said Nono, speaking on behalf of her family. My sister died because she was beautiful and doing matric."Nono said Boitumelo's friends said that on Thursday they saw her get into a car after school. They did not recognise the vehicle. "We got worried when she did not return home. Later we received a call to say she was dead. We understand that they took her into the car, drove with her to a bush in Klipgat and then poured petrol on her and burned her." Nono said Tumi, as she was affectionately called by her family, had dreams of being a crime investigator. She was a dedicated pupil whose subjects included history, life orientation, life sciences, English and Afrikaans. "She was a loving person, she did not want people to get hurt," her sister said. "She always smiled and was very kind."According to Makalepho, his ex told him she will only accept their break-up if he promised to date ugly women who already have children. She also allegedly told him the new woman must not have a matric certificate. "She was angry that I dumped her with a baby," Makalepho said yesterday. "I never thought she can do this, I'm traumatised."Makalepho and his ex have a 19-month-old daughter. "I don't feel that my daughter is safe with her anymore. I dumped her because she cheated on me, she cannot blame me for her failures," he said.North West police spokesman Captain Paul Ramaloko said four people were arrested. NY prison escapee shot twice and captured ALIVE by state trooper


LagosgistDavid Sweat, the surviving prisoner on the run in New York, has been shot and captured alive two miles from the Canadian border. He was shot twice in the torso after an officer patrolling the area spotted him brazenly jogging down the road wearing head-to-toe camouflage. Sergeant Jay Cook, a 21-year veteran, got out his vehicle to question the man before recognizing Sweat. Told to stop, Sweat broke into a run. When he got near a line of trees, almost vanishing from sight, Cook opened fire. Sweat was treated by first responders at the scene then transported to Alice Hyde Medical Center, a small hospital in Malone, New York, just 40 miles from Clinton Correctional Facility, where he broke free on June 6. LagosgistAt 6.25pm, Sweat, with an IV in his arm, was wheeled out of the emergency unit in a stable condition and placed in an ambulance bound for the larger Albany Medical Center, 200 miles south. The ambulance, with a heavy escort of state police vehicles, left eight minutes later. Local residents cheered as he left. 'We got you b*****d,' shouted one woman. Sweat's capture comes two days after his fellow fugitive, double killer Richard Matt, was shot dead by police after leaving a clumsy trail of candy wrappers and liquor bottles in his wake as they fled authorities. It is believed they were using black pepper stolen from hunting cabins to throw police dogs off their scent. Addressing reporters on Sunday night, New York Governor Andrew Cuomo said: 'The nightmare is finally over.'

Former First Lady, Patience Jonathan's ex-security aide murdered


LagosgistDeputy Superintendent of Police, Tamuno Jacob Igbomie, who was Principal Security Officer to the wife of the former President, Patience Jonathan, has been shot dead by unknown assailants. Igbomie’s corpse was found in his Honda Accord car last Friday along the Airport Road, Abuja. The former PSO, who was married with two children, was believed to have been killed by assassins who shot him at close range in his car and left the engine running. A source said the body of the DSP was found early in the morning with all his phones, wallet and other personal effects in tact in the car.“We believe Tamuno was killed by hired assassins because they did not take away anything in his car. His phones and wallets were still with him when his body was found in the car with the engine steaming. “He was shot in the night and his body was found early in the morning; we don’t know if he was killed over a business transaction or disagreement with someone,” the source who served with the deceased at the villa stated. It was gathered that the deceased, who hailed from Okrika, Bayelsa State, was serving at the Federal Capital Territory Police Command before he was deployed to the Presidential Villa as Aide-De-Camp to Patience when her husband was the Vice President. He was later appointed as the PSO to Patience when her husband became the President in 2011. Findings indicate that the late policeman had just been redeployed back to his former position at the FCT Police Command, where he was in charge of posting of junior officers. The Force Public Relations Officer, Emmanuel Ojukwu, confirmed the killing of the policeman, noting that investigation had started to unravel the assailants. “Yes, a DSP attached to the villa was killed last week Friday, investigation has started to find out the people behind the murder. No arrest has been made yet,” he said over the phone on Sunday. Presidency orders VC, registrar of the Fed University of Otuoke to refund overpaid salaries


LagosgistThe Presidency, through the National Salaries, Incomes and Wages Commission, has instructed the Vice-Chancellor of the Federal University, Otuoke, Bayelsa State, Prof. Mobolaji Aluko, to refund over payment of salaries running into millions of naira. The Registrar of the university, David Suowari, was also directed to refundthe sum of N130, 692.71 per month in excess of his due salary. The over payments were said to have been discovered during the commission’s visit to the institution on May 12, 2015 to carry out an inspection of FUO’s remuneration practices vis-a-vis the extant government’s pay policy. The VC and the registrar were accused of appropriating certain allowances to themselves which were not approved by the government.These concerns were raised in a letter from the NSIWC to Aluko, signed for the Chairman of the Commission by the Director of Compensation, Chike Ogbechie. The commission said, “The findings of the inspection in respect of your institution (Federal University, Otuoke) were as follow: “The Vice-Chancellor was being paid total emoluments of N1,970,476.76 monthly, whereas he should not earn more than N922,810.23 if he were paid furniture allowance en bloc earlier, or N1,043,176.79 if he were being paid furniture allowance. “Much of the difference was attributed to certain allowances which were not approved by the government.” In the case of the registrar, the commission said he was being paid N130,692.71 in excess of his due salary of N502,580.25. The commission also said the university disaggregated its staff salaries against the government’s policy of pay consolidation. The NSIWC, therefore, directed the university to stop “the wrongful practices” and comply with relevant rules and rates. The commission added, “We hereby direct the vice-chancellor and the registrar to refund the cumulative overpayments made to them. “You are to report to the commission in writing, your compliance with this directive within four weeks of this letter.” Prof. Mobolaji Aluko became the Vice-Chancellor of the university in February 2011 and he said (in a text message to our Punch correspondent) that there was neither disaggregation of salaries nor overpayment of salaries. The vice-chancellor said, “Rather, pension and health insurance allowances were due to three of us, Diaspora Vice-Chancellors who are on Sabbatical from our foreign universities, and co-paid monthly in naira to us for payment to those foreign universities. “Without that concession occurring, our own local salaries would have been wiped out completely, and we could not have accepted the job.” “However, the need for accountability is welcome, and Salaries and Wages Commission will be fully reconciled to the full facts,” the VC stated.
